TERMS and CONDITIONS

These Terms and Conditions are applicably to any all transactions, be-it financial or analytical in nature, engaged in by Yanka Laboratories, by written quotation acceptance from a supplier, or invoice for acceptance of analytical work by Yanka Laboratories.

  1. SAMPLES received by Yanka Laboratories remains the property of Yanka Laboratories. Any request for return of samples to a customer, must be made in writing upon submission of these samples to Yanka Laboratories. Samples are destroyed after analyses are completed.
  2. RESULTS from analytical services, specifically, the information conveyed by these results, is the service the customer purchases when requesting analyses be performed on samples, and this information remains the intellectual property of the customer.
    1. Use of analytical results for internal Yanka Laboratories purposes, which may involve validation of test methods or instruments or analysts, statistical calculations, etc., remains the prerogative of Yanka Laboratories.
    2. Yanka Laboratories also sells physical products, such as chemicals or instruments, which may not have such intellectual value, and shall not be confused with RESULTS.
  3. PRIMARY CUSTOMER: The person requesting services or products from Yanka Laboratories, or his/her appointee, i.e. the person Yanka is instructed to provide service to-, by the requestor.
    1. Primary Customership does not automatically extend to employees from the same company or organisation as the primary customer.
    2. Results would be transmitted by e-mail or other electronic means to the addresses as instructed by the primary customer, and/or any addresses as instructed by the primary customer.
    3. Disclosure of  results to a third party, be it in the same or a different company or entity, by Yanka Laboratories, would not be undertaken without consent from the primary customer. This may be required in writing to the discretion of Yanka management.
  4. TEST REPORT: The physical pages or electronic spreadsheet or PDF document containing the Test Results, also identified as a Test Report, Analytical Report, Analytical Result sheet(s), or similarly named.
    1. This report may not be partially presented, i.e. broken up and some results or information omitted from the Test Report, without prior written consent from Yanka Laboratories.
    2. A Test Report pertains only to the specific sample(s) tested as identified on the report. Generalizing of sample results to water sources or untested samples, is unfounded.
    3. Samples are tested as received, except where indicated otherwise on the Test Report.
      1. Filtering of samples prior to analysis is undertaken and does not change the "as received" nature of the sample, as only dissolved compounds make up the content of water samples. Solids do not form part of the water sample.
      2. In case of TOTAL metal content required, sub-samples would be acidified in order to dissolve solids present and required as part of the TOTAL sample analysed. Such analyses would be indicated as TOTAL ####.
  5. DUE CARE: Yanka Laboratories takes all reasonable precautions to ensure accuracy, correctness, and applicability of analytical work. However, it is emphasized that all results of analysis or any other notifications are provided on the explicit condition that YANKA LABORATORIES will accept no responsibility whatsoever for any losses or costs that may result from faulty, incorrect, or inappropriate interpretation, use, or application of results.
